Health and Risk Acknowledgment Related to COVID-19

The novel coronavirus, COVID-19, has been declared a public health emergency by the Centers for Disease Control and Prevention (“CDC”). COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

As the owner, I have requested that interior warranty work (the "Warranty Work") be performed at the Property. Owner understands that the Warranty Work will require NVR employees and/or independent contractors to enter the Property, and, in some instances, may come in close contact to the Owner. Notwithstanding the currently heightened risks and inherent dangers associated with COVID-19, and understanding that Owner may elect to delay the Warranty Work, Owner requests that the Warranty Work proceed at this time. In consideration of NVR performing the Warranty Work at this time, and to the fullest extent permitted by law:

  1. Owner represents and warrants that, to the best of Owner’s knowledge:
    1. No occupant of the Property has been diagnosed with or tested positive for, or been placed under voluntary or mandatory quarantine for, COVID-19 in the past 14 days;
    2. No occupant of the Property is currently experiencing or has within the past 14 days experienced any symptoms of COVID-19, as described on the CDC’s website (https://www.cdc.gov/coronavirus/2019-ncov/symptoms-testing/symptoms.html); and
    3. No occupants of the Property have been in close contact with, or cared for, anyone who has been diagnosed with or tested positive for, or been placed under voluntary or mandatory quarantine for, or exhibited any symptoms of, COVID-19 in the past 14 days.
  2. If any occupant of the Property is diagnosed with or begins to exhibit symptoms of COVID-19 prior to, during or within 14 days after performance of the Warranty Work, Owner will immediately notify NVR.
  3. While NVR is following CDC’s recommendations for safety and hygiene and any state-specific requirements, Owner acknowledges and understands the contagious nature of COVID-19 and voluntarily assumes the risk and accepts sole responsibility that Owner and any other occupant, guest or invitee of the Property (this does not include NVR employees or its trade partners) may be exposed to or infected by COVID-19 as a result of the performance of Warranty Work at the Property.
  4. Owner voluntarily agrees to assume all of the risks and accepts sole responsibility for any injury (including without limitation personal injury, disability and death), illness, damage, loss, claim, liability or expense of any kind to Owner and any other occupant, guest or invitee of the Property (this does not include NVR employees or its trade partners), that may occur in connection with the performance of Warranty Work at the Property related to COVID-19.

Owner(s) acknowledges that he/she has reviewed this Acknowledgment with all occupants of the Property, made them aware of its contents and explained to them the disclosures contained in it.
